USER TERMS – 1880 CONCEPT 


1. These Terms

These terms and conditions (“Terms”) apply to all services provided by 1880 Concept ("we," "us," or “1880 Concept”) to you – the customer or user (“you”).

The services include:
• Online analysis: seasonal color analysis, body shape analysis, hair analysis, makeup analysis, style consultation & personal shopping
(Collectively referred to as the “Services”).

By using the Services, you agree to these Terms.

2. Registration & Account

When purchasing a service, you must provide your name, a valid email address, and payment information.

If you create an account, you must keep your password confidential. If a third party uses your account because you disclosed your password, their actions will be deemed as yours.

If you discover unauthorized use of your account, you must notify us immediately.

You must provide a valid email address to receive service information. We are not responsible if you enter the wrong email address.

If you violate these Terms, your account may be suspended or deleted.

3. Payment

Payment must be made before we deliver the Services.

All service prices include taxes.

Once payment is successful, you will receive an email confirmation with details.

By making payment, you confirm that you are 18 years or older, or have permission from a guardian to use the payment method.

4. Refunds & Cancellations

Due to the personalized nature of the services, refunds are strictly regulated:

a. Before Submission

  • If you have not submitted the intake form or images, you may request a refund within 48 hours of purchase by completing the Refund Request Form.

b. After Submission / Service Started

  • Once you have submitted the intake form or images and we have started the analysis, no refund will be given.

  • Services are personalized and non-transferable.

c. Submission Deadline

  • You must submit your completed intake form and valid photos within 7 days of purchase.

  • If no submission is received:

    • Your order will be granted a one-time free extension of 2 days.

    • After this extension, you may continue the service by submitting the form and images with a $7.99 re-activation fee.

  • Orders that remain inactive after the extension will be forfeited without refund.

d. Special Note for Minors / Guardian Payment

  • If a minor uses a guardian’s payment method, refunds are not available once the service has been delivered.

  • Any chargeback or dispute from a guardian after service delivery may be considered fraudulent, and 1880 Concept reserves the right to provide all documentation (emails, intake form, images, PDF results, logs) to the payment processor or bank.

5. Your Obligations

You must:

  • Not share, distribute, or resell any content/data we provide.

  • Provide accurate and up-to-date information.

  • Use only legally owned payment methods.

  • Act politely and avoid disruptive or offensive behavior when dealing with our staff.

  • Complete the questionnaire or provide truthful information for us to perform the service.

6. Rights to Use Analysis Results

  • You are granted the right to use the reports, documents, and content we provide for personal purposes only.

  • You may not copy, distribute, publicly share, or use for commercial purposes without written consent from 1880 Concept.

  • All materials, images, and consulting content remain the intellectual property of 1880 Concept.

  • 1880 Concept reserves the right to retain copies of all reports, intake forms, images, and service outputs for record-keeping and fraud prevention.

7. Your Commitments

When using the Services, you agree to:

  • Provide accurate and complete photos and information.

  • Not send content that is offensive, sensitive, or violates the law.

  • Use the Services for personal purposes only.

  • Communicate respectfully with our staff.

8. Privacy of Information & Images

  • All information and images you provide will only be used for personal style analysis.

  • We do not share your information with third parties without your consent, except as required by law.

  • We may store data internally to improve our Services but will always ensure safety and confidentiality.

  • Anonymized data may be used internally for service improvement and legal compliance, without sharing personal identifiers.

9. Disclaimer of Liability

  • Our analysis and consultation results are for guidance and reference only. We do not guarantee absolute suitability for all circumstances.

  • The Services do not replace medical, nutritional, or health advice. We are not responsible for any decisions regarding health or medical issues based on our Services.

  • Due to the personalized nature of the Services, once analysis has begun with submitted information, fees are non-refundable.

10. Termination & Suspension
  • We reserve the right to suspend or terminate the Services if you violate these Terms.
  • If you have made payment but not submitted photos/information, refunds will follow section 4.
  • If your behavior damages the reputation or interests of 1880 Concept, we reserve the right to refuse service in the future.
  • If fraudulent activity or chargeback disputes arise, 1880 Concept may suspend your account and provide all evidence to the payment processor.
11. Legal Liability

  • We are obligated to provide the Services as described.

  • We do not exclude liability for damages caused by our direct fault (e.g., fraud, gross negligence).

  • We are only liable for foreseeable damages arising directly from the Services.

  • Our maximum liability shall not exceed the amount paid for the Services.

12. General Terms

  • By using the Services, you agree to these Terms and our Privacy Policy.

  • We may assign or subcontract part of the Services to trusted partners.

  • In case of force majeure (natural disasters, epidemics, legal regulations…), both parties shall be exempt from liability.

  • If any provision is deemed invalid under the law, the remaining provisions remain in effect.
